VSWAP Test Suite Terms and Conditions

This test suite is made available as a service to the WAP community by The Open Group.

The test suite is derived from the WAP Forum's application test suite VSWAP.

You may use this test suite to test your products during development or in QA.

You may make not make any public statements concerning the use of the test suite or concerning results obtained from the tests, and in particular you may not make any claim to have "passed" the tests.

You acknowledge and accept that only the official WAP Forum certification test suites maintained by the WAP Forum certification authority may be used for WAP certification.

You accept that the test suite may contain extensions and modifications beyond the official WAP Forum certification tests and You accept that The Open Group makes no claim that the results of using the test suite will be the same as those produced by the official WAP Forum certification test suites

BY USING THE TEST SUITE YOU ACKNOWLEDGE THAT BECAUSE OF THE SPECIAL NATURE OF THE TEST SUITES AND THE OPEN GROUP AND WAP FORUM IT IS REASONABLE FOR THE OPEN GROUP AND WAP FORUM TO EXCLUDE LIABILITY AS SET OUT BELOW AND FOR YOU TO TAKE MEASURES, INCLUDING INSURANCE WHERE APPROPRIATE, TO MITIGATE OR PREVENT ANY POTENTIAL LOSSES THAT MAY ARISE.
THE OPEN GROUP ON ITS OWN BEHALF AND ON BEHALF OF ITS OFFICERS, EMPLOYEES AND AGENTS HEREBY EXCLUDES ALL LIABILITY, WHETHER IN CONTRACT, TORT OR OTHERWISE, ARISING OUT OF OR RELATING TO THE USE OR NON-USE BY ANY PERSON OF THE TEST SUITES OR OTHER INFORMATION PROVIDED BY THE OPEN GROUP TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW. IN NO EVENT SHALL THE OPEN GROUP BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL LOSSES (INCLUDING, WITHOUT LIMITATION, ANY LOSS OF PROFITS, CONTRACTS, PRODUCTION OR USE).
